You will not use the website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the website, you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the website.

2 – ADVICE: The contents of the website do not constitute advice and should not be relied upon in making or refraining from making, any decision.

5.4 Nothing in these Terms and Conditions shall be construed to exclude or limit the liability of your name for death or personal injury as a result of the negligence of Kaleidoscope Babycare or that of its employees or agents.

6 - ACCEPTANCE OF ORDERS - 6.1 All store orders will be acknowledged verbally at the time of order and all orders placed on our website will be acknowledged electronically by email. Please note that verbal and/or electronic acknowledgments do not constitute order confirmation or order acceptance. Your order will be accepted and the creation of a legally binding contract between you and us will take place once the goods have been dispatched or collected. (Alternatively, we may decline all or part of your order for any reason, in which case we will inform you in person, or by telephone or email.)

6.2 The total price payable will be stipulated at the time when you place your order, whether the order has been acknowledged. We are entitled to make adjustments to the price to take account of any increase in our suppliers’ prices, or the imposition of any taxes or duties, or (if due to an error or omission) the price published for the goods is wrong, whether or not the order has been acknowledged. We will inform you of the correct price and give you the opportunity to cancel the order.

6.3 Although we endeavor to ensure that all pricing information on the website is accurate, occasionally an error may occur, and goods may be incorrectly priced. If we discover a pricing error we will, at our discretion, either contact you or ask you whether you wish to cancel your order or continue with the order at the correct price, or notify you that we have cancelled your order. We will not be obliged to supply goods at the incorrect price.

6.4 We ensure that all product information on the website is accurate, occasionally an error may occur, and goods may be incorrectly described. If we discover a description error we will, at our discretion, either contact you or ask you whether you wish to cancel your order or continue with the order. We may contact you and ask you if you would like to pay the difference for the correct item with the correct price or notify you that we have cancelled your order. We will not be obliged to supply goods at the incorrect price.

6.5 Once your order is placed, we will send confirmation by email to the email address provided at checkout. We will issue a receipt immediately and this will be delivered to you with your order.

7 – PAYING IN INSTALLMENTS - We have partnerships with different installment companies

Klarna: Goods will be dispatched straight away.

Layby: Goods will be dispatched straight away.

Splitit: Goods will be dispatched straight away.

ClearPay: Goods will be dispatched straight away.

Partial.ly: We despatch your goods once payment has been received in full.

PayPal: Goods will be dispatched straight away.

5% installment charges for Klarna/Clearpay/Laybuy/Partial.ly/Splitit.

8 - DISCOUNT AND CODE - We have already provided discounts and conjunction with our entire product label with price tag on this website.

In a situation where a discount for a product has worked on a different product not relating to the product promotion issued then Kaleidoscope Babycare has the right to ask the customer whether they like to pay the difference or cancel the purchase. Your entire selected product will be excluded from discounts and promotions. Kaleidoscope Babycare reserves the right to end promotions at any time

9 – INDEMNITIES - You agree to indemnify and hold Kaleidoscope Babycare, its employees, and agents harmless from and against all liabilities, legal fees, damages, losses, costs, and other expenses in relation to any claims or actions brought against our name arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this website.

10 – SEVERANCES - If any of these Terms and Conditions should be determined to be invalid, illegal, or unenforceable for any reason by any court of competent jurisdiction then such Term or Conditions shall be severed and the remaining Terms and conditions shall survive and remain in full force and effect and continue to be binding and enforceable.

11 - Ordering, Return, Exchange and Refund Policy - Your order confirmation from us does not signify our acceptance of your order. We reserve the right to accept or decline your order at any time after receipt of your order for any reason. If your credit/debit card has already been charged for the purchase and your order is cancelled, we shall immediately issue a credit to the credit/debit card used in the order for the amount charged. Certain orders placed must obtain our pre-approval with an acceptable method of payment, as established by our sales department. We may require additional verifications or information before processing and shipping any orders, which in turn may delay your order.

12 - Lost Parcel Resolution Process and Customer Guidance - In some unfortunate cases parcels are lost during transit, During this time though we understand it is an inconvenience Kaleidoscope Babycare is unable to facilitate replacement or refund until the investigation for the parcel with the courier is completed, we will work with the courier to try to resolve as soon as possible. We encourage all our customers to contact directly to the courier company to open a claim so the investigation can be solved as soon as possible.
